OWNERSHIP RIGHTS AND RESPONSIBLITIES
The Photographer will document the events in a candid manner take formal portrait and group shots as indicated on the wedding checklist to be filled out by the clients at the final meeting.
The Photographer and the clients agree that unless stated otherwise in this document, the Photographer owns any and all copyright and reproduction rights. The Clients will receive printing rights, which will allow them to use the photographs in any non-commercial way they wish.
The Clients agree that The Photographer may use any photograph/image for publicity & advertising purposes to promote Kyle Hassall Photography, this may include publication on the photographers website.
Unrestricted, open access to client online album will be provided by the Photographer unless otherwise specifically requested by the Client.
The Clients agree not to alter, re-edit or copy any proof or other photograph of the event, taken by the Photographer, without the Photographers written permission.
The Clients agree that the Photographer will be the sole official photographer of the day and cannot be held responsible for the actions of any photographer acting in an unofficial role.
PAYMENT REQUIREMENTS
To reserve your chosen date, the Photographer requires a booking fee of £400. The Photographer will not hold any date without the receipt of said payment. Said payment is non-refundable for any reason, except if the Photographer cancels the contract.
The remaining balance must be received by The Photographer no later than 14 days before the wedding date. Failure to do so may result in the Clients wedding date being made available to other couples.
CANCELLATION
If the Photographer has to cancel this contract for reasons beyond their control (death, injury, sickness, etc) their liability shall be limited to a full refund of all monies paid.
If, after a period of 14 days from the signing of this contract, the Clients cancel, as compensation for loss of income for the Photographer the following charges apply as a percentage of the total fee due.
60 days or less before the wedding - 100%
61-90 days before the wedding - 75%
91-120 days before the wedding - 50%
Should the said wedding be a postponement, then, subject to availability, all money paid may be applied to the new date.
If the said wedding is postponed and then cancelled, the percentage of compensation shall apply to the original wedding date.
In the event of the Photographer taking another wedding booking on your cancelled date a full, unconditional refund of your booking fee and monies paid will be made.
DISCLAIMER
The Photographer agrees that every effort will be made to provide high quality photographs services.
In the unlikely event that a catastrophic mechanical failure should occur to the Photographer’s equipment or transport and the Photographer is unable to provide the Clients with the agreed upon photography services and/or products, the Photographer’s liability shall be limited to a full refund of all monies paid. The Photographer reserves the right to artistic license to photograph and edit the images according to his style.
